Terms and Conditions

Welcome to ATHLETIK PLUS By accessing or using our services, you agree to comply with and be bound by the following terms and conditions.

 

General Conditions

1. These Terms and Conditions apply to all agreements between ATHLETIK PLUS and the customer for the sale and supply of our products and services. By using our services, purchasing products, or interacting with us in any capacity, you agree to be bound by these Terms.

2. These Terms supersede any other communication or documentation exchanged between the customer and us, unless otherwise agreed upon in writing by an authorized representative of the Company.

3. We reserve the right to update these Terms at any time without notice. All transactions are governed by the Terms in effect at the time of the transaction, and contracts will be subject to the jurisdiction of [Your Location], governed by its courts.

Products

1. We reserve the right to modify or discontinue any product without prior notice. All displayed products and prices are subject to change at our discretion.

2. ATHLETIK PLUS has made every effort to display as accurately as possible the colours and appearance of our products on our website and/or rangeboard, however product images are to be used for illustration purposes only and we take no responsibility for product logo variants or colour variations..

3. Errors in product descriptions or pricing may occur, and we reserve the right to correct inaccuracies and cancel orders where necessary.

Minimum Order Requirements

1. We have a minimum order requirement of 20 per style for custom-made team apparel. Men’s, women’s, and youth apparel are considered separate styles.

2. We reserve the right to refuse or limit orders at our discretion, particularly those that appear to be placed by dealers or resellers.

Price

1. All orders are invoiced at the current price at the time of the order. Prices are in AUD and exclude GST unless stated otherwise.

Payment

1. A 50% deposit is required to begin production. The remaining balance is due before delivery.

2. Orders may be modified or canceled by contacting us. However, once production has begun, cancellations may not be possible.

Logo Placement

1. Our logo will be present on all garments unless otherwise specified. Our logo will be located on the front and back of the garment unless agreed upon between parties.

Production and Delivery

1. Production timelines are typically between 4 to 6 weeks after artwork approval. Delivery will be made during business hours, and a signature will be required.

2. Delays due to incorrect address details or external factors are beyond our control, and additional delivery charges may apply.

Cancellation 

1. Orders may be canceled before production starts without penalty. Once production begins, cancellations are not permitted unless specified in our Returns Policy.

Returns

1. Returns are accepted in accordance with our Returns Policy. Custom-made products cannot be exchanged for change of mind, and refunds are not provided unless required by law.

2. Faulty garments will be repaired or remade at our discretion, provided the issue is reported within 30 days of receipt and proof of fault has been provided by the customer.

Privacy Policy

1. We are committed to upholding the National Privacy Principles as outlined in the Privacy Act 1988 ("Act") and any applicable state or territory legislation regarding the personal information we collect.

2. By providing personal information while accessing our products or services or using our website, you agree to this Privacy Policy and applicable laws. You acknowledge that you have read, understood, and accepted the terms of this Privacy Policy.

3. "Personal Information" refers to any data or opinion (whether true or not, and whether recorded or not) that relates to an identifiable individual.

4. We collect personal information from you when you provide details on our website, contact us via phone, mail, email, or in person, inquire about or purchase our products or services, or enter competitions or special offers.

5. When you browse our site, we automatically receive your computer’s IP address, which helps us understand your browser and operating system.

6. You acknowledge that your personal information (excluding credit card details) may be transferred unencrypted across networks and devices. However, credit card information is always encrypted during network transfers.

7. Although our website operates securely, no internet data transmission can be guaranteed as completely safe. While we strive to protect your personal information, any transmission over the internet is at your own risk.

1. Our products and services are protected by copyright under Australian law and international treaties. Unless otherwise stated, all content, including text, graphics, and software, used in our products and on our website is owned by us or our affiliates, licensors, and licensees.

14. Disclaimer of Warranties & Limitation of Liability

1. ATHLETIK PLUS, along with its affiliates, licensors, licensees, and associated parties, makes no guarantees regarding the suitability, reliability, or accuracy of our products or services. Your use or inability to use our products and services is solely at your own risk.

2. All products and services provided by ATHLETIK PLUS are delivered "as is" and "as available" without any express or implied warranties. The exclusions and limitations outlined in these Terms and Conditions do not exclude any rights under the Competition and Consumer Act 2010 but apply to the maximum extent permitted by law.

3. ATHLETIK PLUS and its associated parties are not liable for any direct, indirect, or consequential damages arising from your use of our products or services, including lost profits or data, even if advised of such possibilities.

Website Information

1. We are not responsible for any loss resulting from actions taken based on information provided on our website. You agree that ATHLETIK PLUS is not liable for decisions made based on the information included or excluded from our site. All limitations of liability in these Terms and Conditions remain effective.

2. We disclaim all warranties regarding the presence of viruses or other harmful components on our site. You are responsible for protecting your data, and we do not guarantee uninterrupted or error-free service.

Indemnity

1. You agree to indemnify and hold ATHLETIK PLUS and its associated parties harmless from any claims, damages, or liabilities arising from your breach of these Terms and Conditions or your violation of any law or third-party rights.

Waiver
